(Unforgetful only asks for the level it needs for the tasks you create. So if you never use delays, it sticks with "when using", and if you never use location reminders at all, it never asks for any access.) But a likely reason is that they just didn't think of it, because most to-do apps seem to be made by people with much more discipline and focus than I have.
The difference is mostly the delay, which stems not necessarily from the regulation itself, but from the incentives in the machinery that administers it.
